Payment, Fees, & Charges on monthly storage subscriptions.
      1. This Victoria Shipping Containers Inc. agreement is in effect from the date in which the renter provides the first payment towards the storage permit forward or until the agreement is terminated, provided the renter pays the agreed month as we may announce. A thirty (30) days’ notice regarding changes to an existing or new fee will be emailed to the address shown in our records.

      2. The monthly payment is due on the 25th and covers the following months’ rent. Failure to make a payment on time will result in your account being moved into arrears.

      3. Accounts in arrears will be subjected to late fees in addition to the monthly charge as detailed in the Late Fees Schedule:
        1. On the 1st day of the month accounts in arrears will have their site access restricted and fob deactivated.
        2. On the last day of the month accounts in arrears will be charged a late fee of $50
        3. on the 45th day in arrears accounts will be subject to a bailiff/auction fee for the amount quoted by a licensed bailiff to cover costs of removal/license fee outstanding.
        4. Accounts 45 days in arrears will be assessed for public auction, with written notification.

      4. Non-Sufficient Funds (NSF) charges are all subject to a $35 processing fee.
      5. A $50 security deposit will be collected for the FOB provided. An additional $75 fee will be charged for all lost or damaged FOB.

      6. A one-time setup fee of NINETY-NINE DOLLARDS ($99) plus applicable taxes shall be paid by the Licensee to the Licensor at commencement.
        This fee will be waived for all RDSLP transitioning customers who transition prior to July 25th, 2023.

      7. The Licensor may terminate the agreement with any Licensee by providing thirty (30) days’ notice.




Liabilities

2.1 All property and chattels brought onto Victoria Shipping Containers Inc. .’s “property” for storage or use, and the licensee coming to and being on the “property” shall be at the licensee’s sole risk and Victoria Shipping Containers Inc.  is in no way or under no circumstance responsible or liable for loss, injury or damage to such property or chattels or for personal injury acquired from any cause, including acts, omissions whether negligent or not, of Victoria Shipping Containers Inc.  its employees, agents, customers or invitees. The Licensor does not take custody, control, possession or dominion over the contents of the Licensee and does not agree to provide protection for the storage facility, premises or the content thereof. All personal property is stored at the Licensee’s sole risk.


Renter’s Obligation
  1. Use of the “property” for the storage of goods of which the licensee is in lawful possession.
  2. Licensee agrees that any employees of Victoria Shipping Containers Inc.  may enter the licensee’s property in the event of emergency. If feasible, advance notice of such entry will be provided to licensee. Licensee will agree to provide any keys needed to move their vehicle to Victoria Shipping Containers Inc.  which will be securely stored on site.
  3. Licensee shall pay the monthly fee established in Section 1.1 before or on the due date. Failure to do so will subject the Licensee to the late fee schedule detailed in Section 1.3.
  4. LICENSEE SHALL NOT STORE PROHIBITED ITEMS SUCH AS: EXPLOSIVE, FLAMMABLE, DANGEROUS, NOXIOUS OR PERISHIABLE GOODS ON THE LOT. (With exception to propane and natural gas tanks associated with stored goods i.e. RV’s. VALVES MUST BE SHUT OFF AT ALL TIMES ON THE “PROPERTY”)
  5. Licensee shall not sublease or carry on any business out of the licensed area without the written permission of Victoria Shipping Containers Inc. 
  6. Licensee shall not use the licensed area for any unlawful purpose.
  7. Licensee acknowledges the licensed area is clean and undamaged and agrees to leave the licensed area in the same condition prior to the termination.
  8. The Licensee may terminate this license by giving written notice of intention to terminate to the Licensor at least one month (30 days) before next rental payment is due.
  9. Stlbx Storage also known as 7549 WEST SAANICH ROAD, SAANICHTON, BC, operated by Victoria Shipping Containers Inc. is a storage facility only. Under no circumstances is it permitted to inhabit the licensed area for any length of time.
  10. The Licensee shall maintain on all personal property in, on or about the Premises, a policy of insurance covering damage by fire, extended coverage perils, water, vandalism, burglary, and pests. The Licensee hereby releases the Licensor from any and all such claims for damage or loss to personal property in, on or about the Premises and hereby waives all rights of recovery against the Licensor and its agents in connection with any damage which is or would be covered by such insurance. To the extent that the Licensee does not maintain the required insurance coverage for the full value of the personal property stored, the Licensee shall be deemed to have been self-insured. All goods of the Licensee are stored at the Licensees sole risk and the Licensee acknowledges notice that they are not covered by any policy of insurance carried by the Licensor.
  11. The Licensee shall forthwith notify the Licensor of any damage or defects in or about the Premises, and shall pay the costs of any repairs for damages caused by the Licensee or his/her invitees. The Licensee shall not make or allow any alterations whatsoever to the Premises without obtaining the prior written consent of the Licensor. Any alterations completed without such consent shall be deemed damage and the cost of restoration shall be due and payable by the Licensee to the Licensor.
  12. The Licensee shall not assign or sublease the Premise or any portion thereof without in each instance the prior written consent of the Licensor, which may be arbitrarily withheld.
  13. The Licensee will be granted access via FOB to the Premise, that will allow the Licensee access to the site. The Licensee agrees that at any time they receive a notification from the Licensor that a ceremony/funeral/event is taking place on Tsartlip First Nation’s cemetery across the street, that no access will be granted during this period

No Warranties: The Licensor hereby disclaims on behalf of itself and its agents any implied or express warranties, guarantees or representations of the nature, condition, safety or security of the Premises and the facility and the Licensee hereby acknowledges and agrees that the Licensee has inspected the Premises and that the Licensor does not represent or guarantee the condition safety or security of the Premises or any property stored therein. This agreement sets forth the entire agreement of the parties with respect to the warranties or agreements other than as expressly set forth herein. Neither party to this agreement may waive any of the provisions hereunder except by written agreement.


Binding Effect: This agreement shall ensure to the benefit of and be binding upon each of the parties hereto and their respective heirs, executors, administrators, successors and permitted assigns.
